Registry Terms & Conditions of Use
This Registry Service ("Service") is provided by Normand-Curle Enterprises Ltd & Triple M Tours. ("Triple M Tours"), conditional on your acceptance of the terms and conditions of use set forth below (the "Terms and Conditions"). These Terms and Conditions apply exclusively to your access to and use of this Service and do not alter the terms or conditions of any other agreement you may have with Triple M Tours. In case of inconsistency between these Terms and Conditions and any other agreement you may have with Triple M Tours, the other agreement shall prevail, but only to the extent of the inconsistency.
Establishing a Trip Registry
Any guest (“Guest”) may setup a Trip Registry. Once a Guest has completed a Tour Registration Form, selected their tour and paid the required deposit amount, the Guest can contact Triple M Tours (by email at firstname.lastname@example.org) to express their desire to participate in the Trip Registry program. Once the Registry has been setup for the Guest, Triple M Tours will email the guest confirmation and a link to the Registry page on triplemtours.ca. The Guest may share this link with whomever they choose.
Contributing to a Trip Registry
The Registry functions via PayPal. Contributors do not need to have a PayPal account to make a contribution. They only need a credit card. There are no minimum or maximum amounts for contributions, except that the total amount contributed by all Contributors will not exceed the Registered Guest’s entire tour cost with Triple M Tours. Contributions to the Gift Registry are kept in Trust by Triple M Tours, within PayPal and are solely used for the Registered Guest’s tour with Triple M Tours. The accumulated funds can only be used towards the Triple M Tours portion of your vacation. It cannot be used for airfare or other expenses related to travel. Once the Trip Registry has reach the amount of your tour cost with Triple M Tours, no further contributions will be allowed. A bi-weekly list of Contributors, contribution amounts and total will be emailed to the Registered Guest(s). Contributions will cease 90 days prior to “the start of your tour”. See our standard Terms & Conditions for the definition of “the start of your tour”.
Registered Guest(s) are subject to Triple M Tour’s standard cancellation policy. Any cancellation fees can be taken from the Registry Fund or paid directly by the Guest(s). It is up to the discretion of the Registered Guest(s) if the remaining funds are to be refunded to the Contributors or forwarded directly to the Registered Guest. If a refund is to be paid to the Contributors, we will only provide refunds via the same method used to make payment and refunds will be processed via PayPal only. Concerns on the means and amounts of disbursement of the Cancelled Registry funds are to be addressed directly with the Registered Guest(s).
If Triple M Tours must cancel the tour due to lack of interest, instructor cancellations, forces of nature, or any other event beyond our control PRIOR to 90 days before departure, again, it is up to the discretion of the Registered Guest(s) if the funds are to be refunded to the Contributors. In this event, there is no cancellation fee charged.
If Triple M Tours cancels only the Registered Guest(s)’ participation in the tour due to violations of our standard Terms and Conditions, before the tour departs, the Registered Guest is subject to our Standard Cancellation policy. Remaining funds will only be refunded directly back to the Contributors, less any cancellation fees incurred by the Registered Guest(s). Concerns on the means and amounts of disbursement of the Cancelled Registry funds are to be addressed directly with the Registered Guest(s).
If Triple M Tours expels the Registered Guest(s)’ from the tour due to violations of our standard Terms and Conditions, after the tour has started, there will be no refunds of any kind to anyone. Concerns from Contributors regarding funds contributed and their lack of refund are to be addressed directly with the Registered Guest(s).
Credit Card Charge-back or PayPal Dispute
If for any reason, the Contributors initiate a credit card charge-back dispute or PayPal dispute, Triple M Tours will deduct the disputed amount from the Gift Registry until the dispute is settled.
Triple M Tours does not directly charge any fees for the use of this service. However PayPal charges a small percentage on each transaction. That amount will be deducted from the amount of the contribution made. Therefore, contributions will not show up on your balance in whole dollar values. For instance a contribution of $100 may have a fee of $2.35, therefore the final amount appearing in your Trip Registry will be $97.65. If refunds are made, the entire original amount is refunded.
Triple M Tours will not accept any liability of whatever nature for any loss or damages whatsoever including acts of omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control. Triple M Tours will not be responsible for any travel decisions, for whatever reason made, made by you nor accept any liability for any injury, damage, lost, delay, additional expense or inconvenience cause directly or indirectly by force majeure or any other event which is beyond our control and not preventable on our part.
You agree to indemnify and hold harmless each of Triple M Tours, its affiliates, and each of their officers, directors, employees and agents, including all third parties mentioned, from and against any and all claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the Service and the Materials or your breach of these Terms and Conditions.
Choice of Law
This Service is controlled, operated and administered by Triple M Tours from its offices within Canada. Triple M Tours makes no representation or warranty that methods and materials of this Service are appropriate or available for use at any locations outside Canada. If you access this Service from outside Canada, you are responsible for compliance with all local law. Each party hereby agrees to submit to the jurisdiction of the courts of Alberta and to waive any objections based upon venue in any such action, suit or proceeding.
Participants will be emailed a hard copy of these Terms and Conditions of Use for signing.
